Agreement and Business Identity

These Terms govern websites, products, services, digital content, courses, memberships, and transactions provided by LaMystique LLC under Fated Mystique Boutique™ and FMB Apparel Co. By using the website, creating an account, placing an order, submitting content, or accessing digital materials, you agree to these Terms and the policies linked at checkout. If you do not agree, do not use the services or complete a purchase.

Eligibility and Accounts

You must be at least 18 and legally capable of entering a contract to make a purchase. You are responsible for accurate account and checkout information, account security, and activity under your credentials. Do not share course or digital-access credentials. Notify us promptly of unauthorized use.

Products Handmade Variations and Intended Use

We make reasonable efforts to display accurate descriptions, prices, availability, photographs, colors, measurements, and specifications. Handmade, small-batch, customized, and screen-displayed products may have minor differences in color, placement, glitter distribution, pattern, texture, finish, measurement, and appearance. These normal variations are not defects.

Products and education are informational, decorative, or intended for craft use as described. We make no medical, therapeutic, safety, income, or results guarantee. Customers are responsible for determining suitability, reviewing labels and manufacturer instructions, testing unfamiliar materials, and using appropriate ventilation, protective equipment, storage, and handling.

Orders Payment and Acceptance

An order is an offer to purchase. We may accept, reject, limit quantities, verify identity, request information, or cancel an order because of availability, pricing or listing error, payment failure, suspected fraud, abuse, sanctions, shipping restrictions, safety concerns, or other legitimate business reasons. If we cancel after payment, we will provide the legally required refund for the canceled amount.

Displayed payment options may include major cards, digital wallets, installment services, or other methods available through Shopify and payment providers. Provider terms also apply. Customers authorize applicable charges, taxes, shipping, and disclosed fees.

Cancellations Personalization and Custom Approvals

Orders may be changed or canceled only before fulfillment begins. Personalization corrections must be requested within 2 hours after purchase. Production of a custom or made-to-order product begins after written approval. Approved details cannot be changed, canceled, or refunded except for our error or rights required by law.

Preorders Backorders and Availability

Preorder or backorder listings will state an estimated availability or processing period when known. Estimates may change because of production, supplier, carrier, or other delays. If a material delay occurs, we may provide notice and any cancellation or refund option required by law. Items in the same order may ship together or separately.

Pricing Promotions Coupons and Errors

Promotions, bundles, rewards, and coupon codes are subject to stated dates, eligibility, exclusions, and quantity limits. Offers may not be combined unless expressly permitted. We may correct typographical, pricing, discount, inventory, or listing errors and may cancel affected orders. If an order is canceled because of our error after payment, we will refund the canceled amount. We will not substitute materially different terms without the customer’s agreement where law requires consent.

Digital Content Courses and License

Digital products, ebooks, templates, graphics, downloads, videos, and course access are licensed, not sold, except for ownership of lawful physical copies. No intellectual-property ownership transfers. Digital purchases are final once purchased, delivered, downloaded, or accessed, subject to mandatory rights. Sharing, resale, redistribution, public posting, account sharing, removal of rights notices, and creation of competing digital products from our content are prohibited. The separate Digital Product and Course License provides additional terms.

Gift Cards Store Credit Loyalty and Memberships

Gift cards, store credit, loyalty rewards, and memberships are governed by their displayed terms and the separate Gift Card Store Credit and Loyalty Terms. They are not redeemable for cash except where required by law, may be subject to exclusions, and may be corrected or revoked when issued through error, fraud, abuse, or an invalid transaction, subject to applicable law.

Reviews User Content and Social Tags

Submitted reviews and content must be truthful, lawful, relevant, and owned or authorized by the submitter. By submitting or publicly tagging us in content featuring our products, you grant the limited marketing license described in the Privacy and Cookie Policy. We may moderate content for fraud, illegality, infringement, personal data, harassment, spam, or policy violations, but we will not suppress honest reviews merely because they are negative.

Affiliate and Referral Programs

Affiliate participation is governed by the separate Affiliate Program Terms, including disclosure requirements, approved claims, commission eligibility, prohibited self-referrals, fraud controls, and termination rights. Affiliates are independent participants and may not bind or represent themselves as LaMystique LLC employees or agents.

Fraud Abuse and Chargebacks

We may use fraud screening, verify identity or order details, limit quantities, suspend accounts, refuse service, cancel risky orders, preserve transaction records, and challenge improper chargebacks with relevant evidence. This does not limit a customer’s right to dispute a legitimate unauthorized or incorrect charge.

Intellectual Property

The website, branding, names, logos, photographs, product descriptions, graphics, designs, course materials, ebooks, videos, templates, and other original content are owned by or licensed to LaMystique LLC and are protected by applicable intellectual-property laws. Limited personal browsing or expressly licensed use is permitted. Unauthorized copying, reproduction, distribution, resale, modification, publication, or commercial exploitation is prohibited.

Disclaimers and Warranty Limitations

To the fullest extent permitted by law, products, website services, and educational content are provided without warranties beyond those expressly stated in writing. We do not guarantee uninterrupted website access, error-free content, compatibility of every material combination, identical craft results, a particular flow rate, cure time, seal, appearance, sales outcome, income, or business result. Manufacturer warranties and mandatory consumer warranties remain unaffected.

Limitation of Liability

To the fullest extent permitted by law, LaMystique LLC and its owners, affiliates, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website, products, digital content, courses, or services. Nothing excludes liability or consumer remedies that applicable law does not permit us to exclude or limit.

Governing Law and Disputes

These Terms are governed by Arizona law and applicable United States federal law, without regard to conflict-of-law principles, except where mandatory consumer law requires another result. Before filing a claim, the parties are encouraged to contact each other and attempt a good-faith informal resolution. No mandatory arbitration agreement or class-action waiver is included in this draft. A dispute may be brought in a court with lawful jurisdiction, subject to mandatory rights in the customer’s location.

Changes Severability and Entire Agreement

We may update these Terms prospectively by posting a revised effective date and providing additional notice when required. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. These Terms and the policies expressly incorporated into them form the agreement for the services they cover.
